Attorney

The County Attorney has a duty to prosecute or defend all civil or criminal suits in which the state or county is a party or interested, on behalf of the state or county. The County Attorney shall appear before any magistrate and conduct any criminal examination, prosecute all civil suits before any magistrate in which the state or county is a party or interested. When the County Board or county officers request opinions or advice concerning duties of the offices or matters in which the state or county may have an interest, the County Attorney shall give opinions or advice for no fee. The County Attorney shall perform all duties enjoined by law upon the county coroner and shall be ex-officio county coroner.

Registration for the Traffic Program must be completed within 10 working days after the receipt of the citation or you will need to appear in court.

Eligible if the citation was for:

  • Crossing the center line
  • Driving on shoulder
  • Failure to yield the right-of-way
  • Following too closely
  • Improper passing
  • Improper turns, backing, lane changes
  • Misuse of school permit
  • Negligent / Careless driving
  • No operator's license on person
  • Overloading front seat
  • Speeding, not more than 10 mph inside city speed limit
  • Speeding, not more than 19 mph, outside city speed limit
  • Violating traffic signs and signals Violation of provisional operator's permit
  • Wrong way in one-way
  • Wrong way, wrong side, improper passing

Not Eligible for:

  • CDL Operator's License Holder
  • Citations for multiple violations (except for Proof of Insurance Not in Vehicle, Not Wearing a Seatbelt, Exhibition of Acceleration, Valid Driver's License Not on Person, Valid Registration Not in Vehicle)
  • Injury accidents
  • Major traffic citations (driving under the influence of alcohol and/or drugs, leaving the scene of an accident, willful reckless or reckless driving)
  • Operating a motor vehicle to avoid arrest
  • Participating in a speed competition
  • Refusing a breath or blood test
  • Speeding (20+ mph outside city limit and 10 mph+ inside city limit)
  • Those who participated in a S.T.O.P Program in the last 3 years

The County Attorney has the right to refuse or accept any individual.
